PHOXY Terms of Service

Last updated: October 20, 2026

1. Operator and service

PHOXY is provided by HMZ Digicorp, Sociedad Limitada (SL), NIF/CIF B02910099, Málaga, Spain, for businesses and consumers in Europe. It is an AI telephone and web-assistant service, with messages and Google Calendar/Microsoft Outlook bookings according to the selected plan. It is not an emergency service or a substitute for professional advice.

2. Account and lawful use

Account holders must be adults and authorised to act for their organisation. Keep information accurate, credentials secure and telephone use lawful. Business customers remain responsible for caller notices, an appropriate legal basis and instructions to PHOXY. Do not use the service for harassment, fraud, unsolicited campaigns or unnecessary sensitive-data collection. A name confirmation verifies spelling, not identity.

3. Prices, taxes and payment

The website’s selected offer and Stripe payment summary identify currency, price, taxes and billing frequency before payment confirmation. Monthly offers renew monthly unless cancelled; do not treat a displayed base amount as tax-inclusive unless the payment summary says so. No purchase is made merely by opening a free demo account. Purchases are not available in the iOS companion app. New paid SMS/email options remain simulated, without real billing or sending.

4. Credits and changes

Included usage and features depend on the plan shown in the offer. Credit packs are separate one-time purchases, not automatic top-ups. Included credits are reset on confirmed renewal; a plan change may reset or reduce the remaining allowance when Stripe confirms it. Do not assume unused included credits roll over or all excess usage is authorised. A paid pack is credited only after server confirmation. Check available balance and the offer before use; credits are not cash or a guarantee of uninterrupted service.

5. Renewal and cancellation

The billing view shows subscription status and the paid period. Website billing management uses the Stripe portal; closing the app or deleting it does not cancel a subscription. Cancellation and account deletion are different requests. Access normally remains for the confirmed paid period when cancellation is scheduled for its end. Telephone-number availability after the paid service ends depends on release and carrier rules; do not rely on indefinite retention. The companion app does not open purchase or plan-change flows.

6. Consumer rights and refunds

Consumers retain mandatory statutory rights, including the applicable 14-day withdrawal period for distance contracts. Starting to use a service does not by itself waive that right. Any immediate-performance request and statutory exception must satisfy the applicable legal requirements. Send an unequivocal withdrawal or refund request through the published contact channel, identifying the subscription and purchase date; no particular wording is required. Legal rights to reimbursement and remedies for non-conformity prevail over commercial restrictions. Business refund requests follow the accepted offer and applicable law.

7. AI, calendars and availability

AI answers and summaries may be inaccurate; review important messages and bookings. Calendar availability may change between a check and a provider update. Refusals or conflicts may require human review. A confirmed name or appointment is not identity authentication. Disconnection stops using the connection but does not erase existing calendar events. No error-free AI or continuous availability is guaranteed; statutory service obligations are not excluded.

8. Data, suspension and applicable law

The privacy notice explains data use and rights. Business processing requires an appropriate processing agreement and lawful customer instructions. Abuse or security risk may justify proportionate suspension, subject to applicable notice and remedies. Spanish law applies without depriving consumers of mandatory protections in their country of habitual residence or their competent courts. No blanket liability cap overrides mandatory rights. Changes affecting an accepted offer must respect applicable notice and consumer rights.
